In case of divorce, who holds parental authority?
Answer. Both parents, together.
Les deux parents, ensemble.
Divorce does not change parental authority. The father and the mother keep the same rights and duties toward their child, unless a judge decides otherwise.
The official text that proves it
« Les deux parents ont tous les deux l’autorité parentale : ils ont les mêmes droits et les mêmes devoirs. Peu importe leur situation (s’ils sont mariés, pacsés, en concubinage ou séparés). »
Both parents hold parental authority, they have the same rights and the same duties, whatever their situation, whether married, in a civil partnership (PACS), living together, or separated.
