Can a pregnant woman or a woman on maternity leave be dismissed because of her pregnancy?
Answer. No. This is discrimination, which is forbidden and punished by law.

Pregnancy is one of the prohibited grounds for discrimination. Dismissing an employee because she is pregnant is a criminal offence, punishable by three years in prison and a 45,000 euro fine. The Code du travail also protects the employee during her pregnancy and her maternity leave.

« est punie de trois ans d'emprisonnement et de 45 000 euros d'amende lorsqu'elle consiste : 1° A refuser la fourniture d'un bien ou d'un service ; 2° A entraver l'exercice normal d'une activité économique quelconque ; 3° A refuser d'embaucher, à sanctionner ou à licencier une personne »
