The death penalty was abolished in 1981, on the initiative of Robert Badinter. Since 2007, the Constitution has prohibited sentencing anyone to death.

The official text that proves it

« La loi constitutionnelle du 23 février 2007 inscrit l’abolition de la peine de mort dans la Constitution de la Vème République de 1958 : l’article 66-1 affirme désormais clairement que "nul ne peut être condamné à la peine de mort". »

The constitutional law of February 23, 2007 writes the abolition of the death penalty into the Constitution of the Fifth Republic of 1958. Article 66-1 now clearly states that no one may be sentenced to death.
